DMCA Policy

1. Overview
ShortsMachine ("we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond promptly to claims of copyright infringement committed using our platform at shortsmachine.ai.
2. Safe Harbor
ShortsMachine qualifies as a service provider under Section 512(c) of the DMCA. We provide a platform that allows users to generate and share video content using AI tools. While we take reasonable measures to prevent copyright infringement, we do not pre-screen all user-generated content. We rely on copyright holders to notify us of any infringing material so that we can take appropriate action.
3. Reporting Copyright Infringement
If you believe that content hosted on our platform infringes your copyright, please submit a written notification to our designated DMCA agent containing the following information:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed. If multiple works are covered by a single notification, provide a representative list.
- Identification of the material that is claimed to be infringing and information reasonably sufficient to allow us to locate the material (e.g., a URL or video ID).
- Your contact information, including your name, address, telephone number, and email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
4. Designated DMCA Agent
Please send all DMCA takedown notices to our designated agent:
We aim to acknowledge receipt of all valid DMCA notices within two business days and to take action within five business days.
5. Counter-Notification Process
If you believe your content was removed or disabled by mistake or misidentification, you may submit a counter-notification to our designated DMCA agent. Your counter-notification must include:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, and that you will accept service of process from the person who filed the original DMCA notification or an agent of such person.
Upon receiving a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10 to 14 business days, we will restore the removed content.
6. Repeat Infringer Policy
In accordance with the DMCA, ShortsMachine maintains a policy to terminate, in appropriate circumstances, the accounts of users who are repeat infringers. A repeat infringer is a user who has been the subject of more than two valid DMCA takedown notices. We may terminate the account of any user after receiving a second valid notice. We reserve the right to terminate any account at our sole discretion if we believe a user is repeatedly infringing upon the copyrights of others, regardless of whether a formal DMCA notice has been filed.
7. Good Faith and Misrepresentation
Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake, may be subject to liability for damages, including costs and attorney's fees. Please ensure that your DMCA notice or counter-notification is accurate before submission.
8. Modifications to This Policy
We may update this DMCA Policy from time to time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of our services after changes are posted constitutes acceptance of the revised policy.
